Introduction
Welcome to Puddingify, Inc. (“Company”, “we”, “our”, “us”). Our website is puddingify.com (the “Site”). We are incorporated in Ontario, Canada, and operate globally. These Terms of Service (“Terms”) govern your use of the Site and Services.
Acceptance
By using our Services, you agree to these Terms. If you do not agree, do not use the Site or Services.
Scope of Services
- We provide cryptographic tooling (hashing, signing, timestamp anchoring, and storage).
- We are not a law firm, notaries, or Qualified Trust Service Providers under eIDAS.
- Use of our Services does not establish legal ownership, authorship, or notarization.
Private Key Custody & Irreversibility
You are solely responsible for the safekeeping of private keys, passphrases, and devices. Lost keys cannot be recovered. Anchors and blockchain transactions may be irreversible. We are not liable for loss caused by key compromise or user error.
Third-Party Networks
Our Service depends on third-party networks (e.g., OpenTimestamps, Bitcoin). Availability, delays, forks, and fees are beyond our control. We disclaim liability for failures of such networks.
Meaning of Hashes & Timestamps
A hash or timestamp proves that data existed at or before a specific time and remained unaltered. It does not prove authorship, originality, or ownership.
User Warranties
- You have rights and lawful basis to upload/process the content you submit.
- You will not upload illegal, infringing, or defamatory content.
- You will comply with applicable privacy and data laws.
- You indemnify Puddingify against third-party claims related to your content.
Content Moderation & Takedown
We may remove or disable access to unlawful or policy-violating content. We follow notice-and-takedown procedures, including DMCA compliance for U.S. users. Contact our DMCA Agent: copyright@puddingify.com.
Prohibited Uses
- No malware or stolen credentials.
- No unlawful personal data uploads.
- No content violating sanctions/export rules.
Service Changes
We may modify or discontinue features, including beta features, at any time.
Liability Limit
Our liability for business/pro users is capped at the greater of CAD $100 or fees paid in the last 12 months. Indirect or consequential damages are excluded to the maximum extent allowed by law.
Governing Law
Ontario, Canada law governs these Terms. Non-consumer disputes will be handled in the City of Toronto, Ontario courts. Consumer protections under local laws still apply where required.
Electronic Contracting
By using our Services, you consent to electronic records and signatures under applicable laws (Ontario E-Commerce Act, ESIGN, UETA, etc.).
Marketing Compliance
We comply with CASL (Canada) and CAN-SPAM (U.S.). We require opt-in consent where applicable and always provide unsubscribe options.
Age Limits
Our Service is not intended for children under the age of digital consent in their jurisdiction. COPPA (<13 U.S.) and GDPR/UK-GDPR (13–16 depending on country) apply. If you are underage, you must not use our Services without verified parental consent.
Refunds, Billing & Disputes
- We process payments through Stripe.
- Subscriptions (monthly/annual) are non-refundable, except where required by law.
- No partial refunds for unused time.
- If service outages occur, we compensate by extending your subscription with free months or credits.
Chargebacks
- Contact support@puddingify.com before filing a chargeback.
- If a dispute is filed, Stripe and we will submit evidence to your bank.
- If decided in our favor, you remain responsible for fees and outstanding charges.
Privacy
Please see our Privacy Policy for how we handle personal data.
Termination
We may suspend or terminate accounts for violations. Data may be retained as required by law.
Changes
We may update these Terms. Continued use after updates means acceptance.

If a chargeback is decided against you, you remain liable for fees and your account may be suspended.
